Voivodeship Administrative Court in Warsaw: migration requires a separate legal basis
The judgment of the Voivodeship Administrative Court in Warsaw of 8 April 2026, the full text of which is available in the Judykatura database, distinguishes archival retention of personal data from its use in launching a new system. The Court confirmed that transferring user accounts together with personal data to a new platform constitutes processing requiring its own legal basis under Article 6(1) GDPR.
