The General Court held that access yields to others’ rights
The General Court’s judgment of 22 April 2026 defines the limits of the right of access to personal data contained in records of whistleblowing and assistance procedures; the full text of the decision in our Judykatura database is also available. The Court confirmed that the right of access under Regulation 2018/1725 requires an actual balancing exercise against the rights and freedoms of others, particularly where the documents contain information capable of revealing witnesses’ identities.
