The Supreme Court of Estonia held that an authority complaint does not bar court action

The order of the Supreme Court of Estonia (Riigikohus) of 1 September 2026 clarifies the relationship between a complaint to a supervisory authority and direct judicial redress; the full text of the decision in our Judykatura database. The Court held that voluntarily commencing proceedings before the Estonian data protection authority does not deprive a data subject of the right to bring parallel proceedings against the controller before an administrative court.
